Diddy's Prison Release Date Moved Up Again, Records Show

Sean "Diddy" Combs is now set to walk out of federal prison on Feb. 5, 2028, about two weeks earlier than the date the Bureau of Prisons had on file at the start of August.

The revised projection appears in Bureau of Prisons records reviewed by People, which reported the change Sept. 3. Combs, 56, is serving a 50-month sentence at FCI Fort Dix in New Jersey after his conviction last year on two counts of transportation to engage in prostitution. A Manhattan jury acquitted him of racketeering conspiracy and sex trafficking, the counts that carried the possibility of decades behind bars.

A Release Date That Keeps Moving

The February date is the latest in a string of revisions. The bureau originally projected June 2028. Records later showed April 25, 2028, and then Feb. 23, 2028, as credited time and program participation were factored in. The projection changed twice more over the summer, first to Jan. 24, 2028 following a reported altercation with another inmate, then back to Feb. 20, 2028 in an Aug. 4 update. The newest entry trims about 15 days off that.

Projected release dates in the federal system are calculations, not commitments. They account for credited time served, good conduct time and completion of qualifying programs, and they shift whenever any of those inputs change. Combs has been in custody since September 2024, and that time counts against the sentence.

The bureau does not explain individual adjustments. The agency does not discuss "conditions of confinement, disciplinary matters" or other details about specific inmates, a spokesperson said, citing "privacy, safety, and security concerns." A representative for Combs declined to comment on the new date.

The Summer Altercation at Fort Dix

The update stands out because it follows a reported disciplinary episode. Combs was placed in solitary confinement after an altercation with another inmate in late July, and his projected release moved later on the calendar in the weeks that followed. Discipline inside a federal facility can cost an inmate earned good conduct credit, which pushes a release date back rather than forward.

The newest record moves in the opposite direction. Combs is also undergoing drug rehabilitation behind bars, People reported. Completing a residential treatment program is one of the few mechanisms that can meaningfully accelerate a federal release date.

The Appeal Still Pending

Combs' lawyers are separately trying to undo the sentence altogether. His appellate team argued before the U.S. Court of Appeals for the 2nd Circuit on April 9, telling the panel that the trial judge relied on conduct the jury had rejected when imposing 50 months, well beyond what defendants convicted under the Mann Act typically receive.

Attorney Alexandra Shapiro said there are "serious constitutional concerns with using acquitted conduct" at sentencing. Prosecutors countered that the sentence rested on behavior Combs admitted, not on the counts he beat. Much of what the district court focused on "was not acquitted conduct at all," Assistant U.S. Attorney Christy Slavik said.

The judges signaled the stakes reach past this defendant. Circuit Judge William Nardini called it "a question of first impression" for the court and, apparently, for "any federal court of appeals in the country." The panel has not issued a decision, and a ruling in Combs’ favor could force a resentencing that resets the release calculation again.

What Comes Next

Until the appeal is resolved, the February 2028 figure remains an estimate that can change with a single disciplinary write-up or program milestone. Combs also faces a stack of civil lawsuits tied to allegations raised during and after the criminal case, and he has denied wrongdoing in each.

For now, the countdown at Fort Dix runs about 17 months, with the caveat that it has already been rewritten several times.
