Wendy's Franchisee Behind 314 Restaurants Files for Bankruptcy

If you’re a fan of Wendy's, you may be seeing some alarming headlines about bankruptcy this week. But, before you start worrying about losing your Frostys and Baconators, there's an important distinction to make.

Wendy's itself hasn't filed for bankruptcy. Meritage Hospitality Group, a major franchisee that runs 314 Wendy's restaurants, filed for Chapter 11 protection on September 17th.

For now, the company says its restaurants will continue to serve customers while it works through the restructuring process.

Who Is Meritage Hospitality Group?

Meritage is a Michigan-based restaurant operator with locations in 15 states. Wendy's makes up the vast majority of its business. 

In addition to its 314 Wendy's locations, Meritage also operates one Bojangles restaurant and five restaurants under independent brands. The company employs about 9,000 people.

So, while this isn't a Wendy's bankruptcy, it does involve a sizable portion of their restaurants.

Why Did the Wendy's Franchisee File for Bankruptcy?

In its September 17th announcement, Meritage cited financial pressures and broader challenges facing the Wendy's brand.

Those problems didn't arrive overnight. Earlier this year, Meritage reported that its second-quarter sales fell from $163.5 million in 2025 to $150 million during the same period in 2026. The company also recorded a $13.6 million net loss for the quarter.

Meritage had already been closing underperforming restaurants and making other changes as it worked to cut costs. The Wendy's franchisee bankruptcy now gives the company an opportunity to reorganize its finances under court supervision.

Are the Restaurants Closing?

Not because of the Chapter 11 filing, at least for now. Meritage said it expects its restaurants to continue operating during the restructuring.

The company is also seeking court approval to continue paying employee wages and benefits, as well as vendors for goods and services provided.

For now, the bankruptcy filing doesn't mean hundreds of Wendy's restaurants are suddenly locking their doors.

Wendy's Has Been Facing Its Own Challenges

The filing comes during a difficult period for Wendy's, as well. Meritage said challenges affecting the Wendy's system have taken a toll on them because so much of its portfolio depends on the brand.

They reported 365 restaurants at the end of 2025 and 320 restaurants by late June 2026.

Those numbers put the Chapter 11 filing into a little bit more context. It wasn't just one disappointing quarter that suddenly sent the company to bankruptcy court.

The Wendy's Sign Isn't Coming Down Yet

Chapter 11 is designed to give a business an opportunity to reorganize while continuing to operate, and that's what Meritage says it intends to do. That means our friends in Michigan shouldn't assume their local Wendy's is closing because it's operated by Meritage.

Of course, restructuring can bring changes as the process moves forward. But, for now, those 314 restaurants are expected to keep serving customers. Thankfully, their next Frosty run shouldn’t be their last.
