Olivier Martinez Granted Restraining Order Against Halle Berry

A Los Angeles judge has granted Olivier Martinez a temporary restraining order against his ex-wife, Halle Berry, after the French actor accused her of physically abusing their 12-year-old son, Maceo. Berry's attorney has called the claims "meritless and deliberately misleading."

Under the temporary order, Berry must stay 100 yards away from Martinez, and her time with Maceo will be limited to a set visitation schedule until a full hearing later this month.

What Martinez Alleges

Martinez filed his request in Los Angeles Superior Court on Thursday, October 1, and a judge granted the temporary order the same day, according to The Statesman, citing court documents first reported by TMZ and People.

In the filing, Martinez claims that on Saturday, September 26, Berry became angry while Maceo was playing a video game with virtual reality goggles. He alleges she called the boy "stupid," jumped on him, put her hands around his neck and choked him.

Martinez also claims Berry texted him the next day. "I feel terrible about what happened last night as I know he does as well," the message read, according to TMZ.

The filing describes what Martinez calls a pattern of physical, verbal and emotional abuse over several years, including alleged incidents involving Martinez himself. He is asking for sole custody of Maceo, though he said he does not oppose his son keeping a relationship with his mother.

None of the allegations have been proven in court.

Halle Berry's Side

Berry's attorney, Marina Beck, pushed back hard on the filing.

"To say this filing is entirely meritless and deliberately misleading would be an understatement," Beck said, according to UNILAD.

Beck pointed to earlier court rulings that she said found Martinez had repeatedly violated court orders and interfered with Maceo's therapy and education. She said he had been legally sanctioned for that conduct.

Martinez's attorney, Patrick Baghdaserians, said the focus is on the boy. "Our paramount concern right now is only one real issue, and that's protecting this great kid," he said.

What Happens Next

The temporary order does not cut off contact between Berry and her son. She will still have scheduled visits with Maceo while the order is in place. Both parents have also been told not to make negative remarks about each other in front of him.

A hearing on whether to make the restraining order longer lasting is set for October 16. A judge will hear from both sides before deciding whether to extend, change or drop the order.

Celebrity custody disputes involving emergency orders have made headlines before. Earlier this year, "General Hospital" star Kirsten Storms was limited to supervised visits with her daughter after her ex-husband was granted an emergency restraining order.

A Long Custody Battle

Berry, 60, and Martinez, 60, met while filming the movie "Dark Tide." They married in France in 2013, and Maceo was born that October. The couple announced their split in 2015, but their divorce was not finalized until 2023, after about eight years of legal proceedings.

Under the divorce settlement, the two share joint legal custody of Maceo. Berry was ordered to pay Martinez $8,000 a month in child support, plus 4.3% of any income above $2 million.

The fight over Maceo did not end there. In 2024, Berry asked the court for sole legal custody of their son, claiming Martinez refused to co-parent in a "child-centered way," People reported at the time.

Berry is also the mother of a daughter, Nahla, with her ex-boyfriend Gabriel Aubry. The Oscar winner made history in 2002 as the first Black woman to win the Academy Award for best actress, for "Monster's Ball."
